FLOTTE reserves the right to modify these General Conditions of Sale at any time by publishing a new version on the Site. The applicable General Conditions of Sale are those in force on the Site on the date the Customer places the order; it being specified that any order for a Product offered on the Site implies full acceptance by the Customer of the General Conditions of Sale in force at the time of placing his order.

These General Conditions of Sale are intended to define the rules applicable in the context of the sale of branded products. ARTICLE 2 • PRODUCTS

Products offered for sale by FLOTTE are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the photograph, the sizes and colors available, the composition, as well as the particular characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user's screen.

FLOTTE undertakes to deliver, within the limit of available stocks, Products meeting the regulations in force relating to the safety and health of persons in accordance with European provisions, and in particular the legislation on regulated chemical substances.

Information on product availability is provided to you at the time of ordering. In the event of unavailability of a product after placing the order, FLOTTE undertakes to inform the customer by e-mail upon receipt of the information as soon as possible. The order for this product will be automatically canceled, the rest of the order remaining firm and final.

 The refund will be made directly to the customer's bank account no later than thirty days from the payment of the sums paid by the customer.


ARTICLE 3 • PRICE 

The prices are indicated in Euros all taxes included, excluding delivery costs; it being specified that the value added tax is that in force in mainland France on the day of the validation of the order.

The prices applied are those communicated on the Site, are guaranteed within the limit of available stocks and confirmed to the Customer during the validation of the order.

The delivery costs are communicated to the Customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the Customer and are invoiced in addition to the sale price of the Products.

The risk of loss and deterioration of the Products will be transferred after delivery and receipt of the Products by the Customer.

ARTICLE 4 • ORDER AND PAYMENT OF PRODUCTS

 

• 4.1 PLACING AN ORDER

The Customer materializes his order by completing the following 5 steps

Step 1: When placing their first order, the customer must create a customer account by filling out a form containing the following information: title, name, first name, full delivery address, e-mail and telephone number. It then specifies the chosen delivery method. Subsequently, the customer must identify himself, by entering his e-mail and password. The customer is informed and accepts that entering these two identifiers (e-mail address and password) constitutes proof of his identity and manifests his consent. The customer declares to be 18 years old or, failing that, to have parental authorization allowing him to place the order on the site.

Step 2: the Customer selects the chosen Products and adds them to his basket after having selected the desired size and color.

At any time he will have the possibility:

  • Obtain a summary of the selected products by clicking on the link at the top right of the "My basket" screen with the indication of the number of Products it contains

  • Continue shopping by clicking on the "Continue shopping" link

  • Complete your selection and place the order by clicking on the "Order" link

 

Step 3: the Customer checks the contents of his basket by clicking on "order" in order to have access to the summary of his order. The Customer can then modify his order (Product, size, quantity).

The total amount including tax of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary. Once the order has been verified and if necessary modified, the Customer validates his basket in order to finalize his order by clicking again on "order".

If the Customer has an advantage code, he must enter it in the space provided for this purpose in order to be able to benefit from it.

 

Step 4: Customer input of delivery and billing details

Apart from the date of birth, additional address and delivery information, all fields are necessary to complete the order; it being specified that unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will identify himself only with his e-mail address and password.

The Customer then checks all the information and clicks on "validate" to continue with his order.

 

Step 5: Enter bank details

The Customer will then access the partner's secure payment screen FLOTTE as specified in article 4.3 below.

Payment is made online by credit card only.

The Customer must enter his bank card number, its validity date as well as the 3 numbers of the visual cryptogram on the back of his card, it being specified that in the event of payment by American Express card, the Customer must communicate 4 digits.

If payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

In the event of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. At the end of the 3rd refusal, the Customer will be redirected on the Site to a screen indicating the refusal of payment. The Customer will then be invited to contact customer service FLOTTE to find out the reasons and jointly find a solution to finalize the Customer's order.

 

• 4.2 ORDER CONFIRMATION

As soon as the Customer has accepted payment, the Customer will receive an email confirming his order, and summarizing all the items ordered, the billing and delivery address as well as the date of delivery.

The validation of the order by the Customer and the order confirmation sent to the Customer by email by FLOTTE following the acceptance of the payment are worth the conclusion of a sales contract between the Parties and acceptance of the General Conditions of Sale.

The Customer who has placed an order will be able to print his invoice by connecting to the Site in the order tracking area provided for this purpose.

FLOTTE reserves the right not to validate the order in the event of:

  • abnormal or abusive complaints,

  • abnormal orders with regard to the quantities ordered,

  • abnormal or abusive exchanges and returns,

  • existing dispute (s) with the customer.

We reserve the right to refuse an order for a legitimate reason, for example in the following circumstances:

  • The ordered item is no longer in stock;

  • We were unable to obtain payment authorization;

  • An error has been identified in the information relating to the product, including with regard to the price or a promotion; and or

  • If we suspect fraudulent activity.

In all cases, we will inform you accordingly, and if payment for your order has already been made, we will reimburse you without delay and in any event within 30 days.

For all orders over 120 € FLOTTE may request proof of identity before preparing and shipping the order.

• 4.3 PAYMENT

The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer. Payment is made online by the following payment methods (Carte Bleue, Visa, Mastercard, Paypal) at the time of validation of the order by the Customer.

The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. FLOTTE reserves the right to proceed with a new direct debit authorization request in the event that the first could not be completed due to unavailability of the servers.

In the event of a payment default, an incorrect address or any other problem on the Customer's account, FLOTTE reserves the right to block the Customer's order until the problem is resolved.

• 4.4 ORDER ARCHIVING

The order confirmation is recorded in the registers FLOTTE, themselves stored on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

 

ARTICLE 5 • DELIVERY

Delivery time :

Any order confirmed on the Site is in no way opposable, any order recorded from Monday to Thursday will be processed the same day; after 15 p.m. it will be processed the next day. Any order placed on Friday, Saturday and Sunday will be processed on Monday or Tuesday (depending on the carrier); it being specified that orders placed on a public holiday will be processed the following working day.

In the event that the delivery period is exceeded, not justified by a case of force majeure, the Customer may request the resolution of the sale and obtain, within a maximum period of 30 days, the reimbursement of the sums paid on the occasion of the sale.

We strive to deliver orders within 10 working days for delivery to mainland France, and 20 working days for delivery to any other destination, from the day following payment of the order. .

However, in times of high activity, deliveries may take longer. We remind you that Saturday and Sunday are not counted as working days. If your order has not arrived within ten working days, please contact our Customer Service:

Please also note that no change of delivery address can be made after placing your order.

FLOTTE reserves the right to refuse to deliver orders from individuals to collective addresses such as, for example, offices, healthcare establishments, stays. In the event of delivery to a collective address, the customer acknowledges that the obligation FLOTTE for the delivery of the order stops at the actual delivery to the collective address indicated in its order form, even though the shipment is not received by the final recipient but by a third party.

For orders outside France, when the package intended for export reaches its destination, the recipient will be responsible for paying the taxes or customs duties that apply to the country of destination. Local authorities can provide you with useful information.

 

ARTICLE 6 • RECEPTION OF THE ORDER - CLAIMS - RETURNS

After this period, and except for hidden defect, no complaint will be accepted by FLOTTE, the Products then being deemed to comply, and FLOTTE will be released from any liability.

 

FLOTTE reserves the right to ask the customer to return the defective product to him. If the above conditions are met, FLOTTE  will then proceed to the exchange, the delivery of a credit note, the reimbursement of the defective product (s), or the reshipment of the missing product (subject to the validity of the buyer's request).

For any return of a non-conforming Product, the Customer must comply with the following procedure:

When the non-conformity has been noted, FLOTTE will offer the Customer either:

  •  the reimbursement of the price of the order (price of the Products), at the latest within thirty (30) days from the day of receipt of the non-compliant Product (s) by the customer service of the site FLOTTE.

In case of reimbursement, FLOTTE will ensure the reimbursement of all products made compliant, with the exception of taxes and customs duties paid by the customer upon delivery.

ARTICLE 7 • RIGHT OF WITHDRAWAL

For any exchange or return within the framework of the provisions of Articles L 121-16, the procedure below must be fully respected:
