General terms and conditions of sale

PREAMBLE

The present sales conditions are concluded on the one hand by the company Flotte, SAS with a capital of 1 000 €, whose head office is located at 22 boulevard Voltaire 75011 Paris, registered at the RCS of Paris under the number 889 416 483, hereinafter referred to as "FLOTTE", and on the other hand, by any individual or legal entity wishing to make a purchase via the website www.flotte.fr, hereinafter referred to as "the Customer".

FLOTTE reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Site. The General Terms and Conditions of Sale applicable are those in force on the Site on the date the Customer places the order; it being specified that any order for a Product offered on the Site implies the Customer's full and complete acceptance of the General Terms and Conditions of Sale in force at the time the order is placed.

The present General Terms and Conditions of Sale are intended to define the rules applicable to the sale of FLOTTE branded products on the Site, any individual of legal age or minor with parental authorization, non-trading, with the legal capacity to contract, exclusively domiciled in the countries delivered by www.flotte.fr making a purchase of a Product on the Site.

 
 

ARTICLE 1 - PURPOSE

The purpose of the present General Terms and Conditions of Sale is to define the conditions under which the Products are marketed by FLOTTE to the Customer. They regulate the various stages of the sale: from the placing of the order by the Customer to the delivery of the Product to the Customer.


 

ARTICLE 2 - PRODUCTS

The Products offered for sale by FLOTTE are those appearing on the Site on the day of its consultation by the Customer. Each Product will be the subject of a description sheet which, in addition to the photograph, will contain: the price, the photograph, the available sizes and colors, the composition, as well as the particular characteristics. Minor differences between a product and its photograph may exist, depending in particular on the resolution and color definition of the user's screen.

FLOTTE undertakes to deliver, within the limits of available stocks, Products that comply with the regulations in force relating to the safety and health of persons in accordance with European provisions, and in particular with the legislation on regulated chemical substances.

Information on the availability of products is provided at the time the order is placed. In the event that a product is not available after the order has been placed, FLOTTE will inform the customer by e-mail as soon as possible. The order for this product will be automatically cancelled, the rest of the order remaining firm and definitive.

 The refund will be made directly to the customer's bank account within thirty days of payment of the amounts paid by the customer.


ARTICLE 3 - PRICES 

The prices are indicated in Euros, all taxes included, excluding delivery costs; it being specified that the value added tax is that in force on the French metropolitan territory on the day of the validation of the order.

The prices applied are those communicated on the Site, are guaranteed within the limits of available stocks and are confirmed to the Customer during the validation of the order.

Delivery costs are communicated to the Customer on the order summary before the validation of the order and are expressed inclusive of all taxes. These costs are payable by the Customer and are invoiced in addition to the sale price of the Products.

The transfer of the risks of loss and deterioration of the Products will be realized after delivery and reception of the Products by the Customer.

We reserve the right to modify our prices at any time but we commit ourselves to apply the prices indicated on the Site at the time of your order.

We inform you that in case of display of an erroneous price, obviously derisory (low price), whatever the reason (computer bug, manual error, technical error.), the order -even validated by us- will be cancelled, of which we will inform you as soon as possible. You will then be able, if you wish, to place your order again at the correct price.

For deliveries abroad, the recipient may be required to pay delivery and customs fees, depending on the legislation in force in the country of destination.

 

ARTICLE 4 - ORDERING AND PAYMENT OF PRODUCTS

 

- 4.1 PLACING AN ORDER

The Customer materializes his order by completing the following 5 steps

Step 1: When ordering for the first time, the customer must create a customer account by filling out a form containing the following information: title, last name, first name, complete delivery address, e-mail and telephone number. He then specifies the delivery method chosen. Thereafter, the customer will have to identify himself, by entering his e-mail and his password. The customer is informed and accepts that the seizure of these two identifiers (e-mail address and password) is worth proof of his identity and expresses his consent. The customer declares to be 18 years old or, failing that, to have a parental authorization allowing him/her to proceed with the order on the site.

Step 2: The Customer selects the chosen Products and adds them to his/her shopping cart after having selected the desired size and color.

At any time he will have the possibility :

  • Obtain a summary of the selected products by clicking on the link at the top right of the screen "My cart" with the indication of the number of Products it contains

  • Continue shopping by clicking on the "Continue Shopping" link

  • Complete your selection and place your order by clicking on the "Order" link

 

Step 3: The Customer checks the contents of his basket by clicking on "order" to have access to the summary of his order. The Customer can then modify his order (Product, size, quantity).

The total amount of the order, including VAT, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary. Once the order has been checked and modified if necessary, the Customer validates his basket in order to finalize his order by clicking again on "order".

If the Customer has a benefit code, he/she must enter it in the space provided in order to benefit from it.

 

Step 4: Entering of delivery and billing information by the Customer

Except for the date of birth, the additional address and the delivery information, all fields are required to finalize the order; it being specified that unless otherwise indicated by the Customer, the billing address will automatically be the same as the delivery address.

If the Customer has already placed an order on the Site, he/she has a customer account. In such a case, he will identify himself only with his e-mail address and password.

The Customer then verifies all the information and clicks on "validate" to continue his order.

 

Step 5: Entering bank details

The Customer will then access the secure payment screen of the FLOTTE partner as specified in article 4.3 below.

Payment is made online by credit card only.

The Customer will have to enter his credit card number, its date of validity as well as the 3 numbers of the visual cryptogram present on the back of his card, being specified that in the event of payment by American Express card, the Customer will have to communicate 4 figures.

If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

In case of failure of payment, the Customer will have up to 3 attempts to enter his bank details again. After the third refusal, the Customer will be redirected on the Site to a screen informing him/her of the payment refusal. The Customer will then be invited to contact FLOTTE's customer service to find out the reasons for the refusal and to work together to find a solution to finalize the Customer's order.

 

- 4.2 ORDER CONFIRMATION

As soon as the Customer's payment is accepted, the Customer will receive an e-mail confirming his or her order and summarizing all the items ordered, the billing and delivery address and the delivery date.

The validation of the order by the Customer and the confirmation of the order sent to the Customer by e-mail by FLOTTE following the acceptance of the payment constitute the conclusion of a sales contract between the Parties and the acceptance of the General Sales Conditions.

The Customer who has placed an order will be able to print his invoice by logging on to the Site in the order tracking area provided for this purpose.

FLOTTE reserves the right not to validate the order in case of :

  • abnormal or abusive claims,

  • abnormal orders with regard to the quantities ordered,

  • Abnormal or abusive exchanges and returns,

  • existing dispute(s) with the customer.

We reserve the right to refuse an order for a legitimate reason, for example in the following circumstances

  • The ordered article is no longer in stock;

  • We were unable to obtain payment authorization;

  • An error has been identified in the product information, including price or promotion; and/or

  • If we suspect fraudulent activity.

In all cases we will inform you accordingly, and if the payment of your order has already been made, we will refund you without delay and in any case within 30 days.

For all orders over 120 €, FLOTTE may ask for a proof of identity before the preparation and shipping of the order.

The customer service of the FLOTTE website is at the disposal of the Customer for any questions related to his order. The customer service is available :

 

- 4.3 PAYMENT

The price of the Products purchased is payable in full on the day the order is placed by the Customer. The payment is made online by the following payment methods (Credit Card, Visa, Mastercard, Paypal, Scalapay) at the time of validation of the order by the Customer.

A payment in three times without fees (payment method currently unavailable for Monegasque Internet users) is proposed to the Internet user (if the service is available on the Site) by our partner Scalapay, for any order of an amount higher than 150 euros. Partial payments by gift cards are not available with this payment solution.

The payment by Scalapay: is made online when placing an order. It is secured by Scalapay and also allows you to make your purchases in complete security. The payment is made in three instalments: 1st instalment at the time of the purchase, the 2nd instalment at 1 month after the day of the purchase, the 3rd instalment at 2 months after the day of the purchase.

The Internet User, if he chooses the payment method in three times without fees, will have to accept the terms of use, or the general terms of sale, as well as the confidentiality policy of SCALAPAY, which will then become his only contact for any question or request relating to this payment solution. The Internet user will have to make the necessary to obtain any information on this payment method, to appreciate it with regard to its own capacities of refunding and thus to avoid a risk of over-indebtedness.

The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. FLOTTE reserves the right to make a new direct debit authorization request in the event that the first request is unsuccessful due to server unavailability.

In the event of non-payment, an incorrect address or any other problem with the Customer's account, FLOTTE reserves the right to block the Customer's order until the problem is resolved.

In the event of fraudulent use of his bank card on the Site, the Customer is invited to contact FLOTTE via chat or by e-mail: hello@flotte.fr

All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time shall the Customer's financial data pass through the FLOTTE computer system. Stripe verifies that the connection with the Customer's browser is secure before sending the payment form to the banking institution that carries out the financial transaction.

As Stripe is a technical service provider, it does not handle disputes related to orders, which are handled directly by FLOTTE as specified above or, where applicable, by the Customer's bank.

 

- 4.4 ARCHIVING OF THE ORDER

The order confirmation is recorded on FLOTTE's registers, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

 

ARTICLE 5 - DELIVERY

Delivery time :

Any order confirmed on the site are in no way opposable, any order placed from Monday to Thursday will be processed the same day; after 3pm, it will be processed the following day. Any order placed on Friday, Saturday and Sunday will be processed on Monday or Tuesday (depending on the carrier); it being specified that orders placed on a holiday will be processed the next business day.

If the delivery time is exceeded and not justified by a case of force majeure, the Customer may request the cancellation of the sale and obtain a refund of the sums paid for the sale within a maximum period of 30 days.

We strive to deliver orders within 10 working days for delivery to Metropolitan France, and 20 working days for delivery to any other destination, starting the day after payment of the order.

However, during busy periods, deliveries may take longer. We remind you that Saturday and Sunday are not counted as business days. If your order has not arrived within 10 business days, please contact our Customer Service Department:

Please also note that no change of delivery address can be made after your order has been placed.

FLOTTE reserves the right to refuse to deliver orders from private individuals to collective addresses such as offices, health care institutions, or residential facilities. In case of delivery to a collective address, the customer acknowledges that FLOTTE's obligation for the delivery of the order stops at the effective delivery to the collective address indicated in the order form, even if the shipment is not received by the final recipient but by a third party.

For orders outside of France, when the parcel intended for export reaches its destination, it is the recipient's responsibility to pay any taxes or customs duties that apply in the destination country. The local authorities can give you useful information.

 

ARTICLE 6 - RECEIPT OF THE ORDER - COMPLAINTS - RETURNS

We do our best to ensure that all our products meet the high quality standards that our customers expect. However, in spite of the special care taken in processing the order, it may happen that some products slip through our checks and inspections. Therefore, upon receipt of the order, the customer is obliged to check the conformity of the Products received in execution of the order at the time of delivery.

In case of damaged package, we ask you not to receive a damaged package (packaging with visible traces of opening and / or deterioration): it must be refused. Indeed, the packages leaving the warehouses of the site onparledevous.fr are always impeccable, and must be delivered to you in this state. If no reservation has been made, we will not be able to take into account the possible disappearances, nor to proceed to a compensation.

Any anomaly concerning the delivery such as:

  • missing products,

  • deteriorated products,

  • If the products do not conform to the order, they must be notified to our Customer Service Department on the day of receipt or at the latest 3 days after receipt:

  • by email hello@flotte.fr or via chat

Please include as much detail as possible about the order and the problem with the products.

After this period, and except for hidden defects, no claim will be accepted by FLOTTE, the Products being then deemed to be in conformity, and FLOTTE will be released from any responsibility.

 

FLOTTE reserves the right to ask the customer to return the defective product. If the above-mentioned conditions are fulfilled, FLOTTE will then proceed with the exchange, the delivery of a credit note, the reimbursement of the defective product(s), or the reshipment of the missing product (subject to the validity of the buyer's request).

For any return of a non-conforming Product, the Customer must respect the following procedure:

  • The customer will have to fill the form of return accessible on the site heading "Exchanges & returns".

  • You will receive a validation by e-mail including on the one hand, a confirmation of return with the return form that the Customer will have to join to his parcel, no return will be accepted without the aforementioned return form duly completed.

  • Products must be returned in their original packaging in perfect condition for resale (shoe box, plastic pouches, etc.), with their label and any accessories, in perfect condition to : E-boutique FLOTTE - 22, boulevard Voltaire - 75011 Paris. Returns of washed and/or worn clothes, as well as damaged boxes will be refused.

  • For all returns, please keep your shipping receipts. Make sure your return is well packaged to avoid any damage to the products or boxes.

When the non-conformity has been established, FLOTTE will propose to the Customer either :

  •  replacement of the Product(s) at the expense of FLEET, either

  •  reimbursement of the price of the order (price of the Products), at the latest within thirty (30) days from the date of receipt of the non-compliant Product(s) by the FLOTTE website's customer service.

In the event of a refund, FLOTTE will reimburse all the products returned in conformity, with the exception of the taxes and customs duties paid by the customer at the time of delivery.

In case of abnormal or abusive complaints, FLOTTE may refuse to serve a subsequent order.

 

ARTICLE 7 - RIGHT OF WITHDRAWAL

Only orders placed on www.flotte.fr can be returned or exchanged by FLOTTE. The Customer has a period of 14 working days from the date of receipt of the order to return the Products ordered, without justification or penalty.

For any exchange or return under the provisions of Articles L 121-16, the procedure below must be fully respected:

  • The customer must fill out the return form accessible on the site under the heading "Exchanges & Returns".

  • You will receive a validation by e-mail including on the one hand, a confirmation of return with the return form that the Customer will have to join to his parcel, no return will be accepted without the aforementioned return form duly completed.

  • Products must be returned in their original packaging in perfect condition for resale (shoe box, plastic pouches, etc.), with their label and any accessories, in perfect condition to : E-boutique FLOTTE - 22, boulevard Voltaire - 75011 Paris. Returns of washed and/or worn clothes, as well as damaged boxes will be refused.

Subject to the above-mentioned conditions, FLOTTE will reimburse the Customer for the amount of the order including VAT. The return costs are invoiced in case of a final return and are automatically deducted from the refund. The Customer's bank account will be credited with the said amount within 30 days of receipt of the Products by FLOTTE.

 

ARTICLE 8 - PERSONAL DATA

FLOTTE collects a certain amount of information necessary to process orders.

These data are not only necessary for FLOTTE to process the Customer's order, but also to communicate information to the Customer about the FLOTTE brand, about the Website or to allow the Customer to benefit from FLOTTE's commercial offers; if the Customer accepts this when validating his order.

The information is strictly confidential and is marked with an asterisk (*) when it is necessary for FLOTTE and/or its service providers to manage the Customer's order.

Following any injunction from the legal authorities or in order to defend its rights or those of its employees, customers or any other person, FLOTTE may communicate this data to the legally authorized bodies and authorities.

FLOTTE undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being distorted, damaged or accessed by unauthorized third parties.

The Customer's personal information is sent to and stored at the site's host located in France, whose contact details are listed on the site under the heading "Legal Information".

In accordance with the law "Informatique et Liberté" of January 6, 1978, as amended by the law of August 6, 2004, the Customer has the right to access, rectify, modify and delete data concerning him.

The site is declared to the Commission Nationale de l'Informatique et des Libertés - CNIL under the n° 1351361. ARTICLE 9 - INTELLECTUAL PROPERTY 

All elements of the site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent.

They are the exclusive property of FLOTTE. Users who have a personal website and who wish to place a simple link on their site for personal use, directly to the homepage of the site, must request authorization from FLOTTE.

On the other hand, any hypertext link referring to the site and using the framing or in-line linking technique is strictly prohibited.

In any case, any link, even tacitly authorized, must be withdrawn on simple request by FLOTTE.
Hypertext links may lead to sites other than the site. FLOTTE declines all responsibility in the event that the content of these sites contravenes the laws and regulations in force.

 

ARTICLE 10 - COOKIES

In order to process the Customer's order, and in order to better understand the Customer's needs and personalize the services offered on the Site, FLOTTE uses cookies. A cookie is a computer file stored on the hard disk of the Customer's computer, the purpose of which is to indicate that the Customer has visited the Site.

The cookies memorize, the time of visit of the Customer on the Site, his identity (known thanks to his electronic address and his password) and the contents of his basket. Once disconnected from the Site, this information is stored for 30 days before being permanently deleted.

The Customer can oppose the recording of cookies by configuring his Internet browser. He will then lose all personalization of the service offered on the Site.

ARTICLE 11 - LIMITATION OF LIABILITY

Placing an order on the Site implies knowledge and acceptance of the procedures in force on the Internet network, particularly with regard to technical performance, response times, connection times, queries or transfers of information, risks of interruption, risks of contamination by viruses circulating on the network and, in general, all risks related to the use of the Internet network.

FLOTTE may not be held liable for any direct or indirect damage resulting from misuse or incidents related to the use of the computer, Internet access, care or malfunctioning of servers, telephone lines or any other technical connection, as the Customer's connection to the Site is his/her sole responsibility.

 

ARTICLE 12 - FORCE MAJEURE

FLOTTE shall not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if such non-performance is caused by an event constituting force majeure as defined by positive law.

In such a case, FLOTTE will inform the Customer of the occurrence of such an event within three clear days of its occurrence, by e-mail.

After a period of one month, and in the event that the event constituting a case of force majeure persists, the order will be cancelled and, if necessary, a refund will be made to the credit card used to place the order within a maximum of 30 days.

ARTICLE 13 - APPLICABLE LAW

If any of the terms of these General Terms and Conditions of Sale should be declared null and void, illegal or unenforceable by a court decision, the other provisions of the General Terms and Conditions of Sale shall remain in force.

The General Terms and Conditions of Sale are executed and interpreted in accordance with French law.

In case of litigation, the customer will contact FLOTTE in order to obtain an amicable solution. If no agreement is reached, the Commercial Court of Paris will be the only competent court
